Terms and conditions for chefs
SoCool Chef
These Terms and Conditions (hereinafter, "the Terms") regulate the collaboration relationship between SoCool Chef (hereinafter, "the Company") and the Collaborating Chefs (hereinafter, "the Chef").
By accepting a service under the SoCool Chef brand, the Chef acknowledges having read and accepted these Terms.
1. Purpose of the collaboration
- SoCool Chef acts as an intermediary between private clients and professional chefs.
- The Chef provides their services independently, respecting the quality, food safety, and customer service standards defined by the brand.
- These Terms establish mutual rights and obligations in the execution of each service.
2. Registration and requirements
To collaborate with SoCool Chef, the Chef must:
- Register in the "Work with Us" section of the official website and provide all the requested information to enter the validation and event assignment process.
- Submit the following documentation and material:
- Photos of dishes and a culinary proposal representative of their style.
- Professional photographs of the Chef.
- Updated Curriculum Vitae.
- Self-employment registration certificate (or equivalent document in their country).
- Valid Driver's License.
- Bank account certification (IBAN/BIC or document issued by the entity).
- Comply with current regulations on HACCP / hygiene and food safety.
- Have an essential kit of personal utensils (knives, cutting boards, tongs, etc.).
- Maintain an updated profile in the SoCool Chef database (availability, specialties, experience).
3. SoCool Chef service standards
The Chef commits to complying with the following standards:
- Active communication: be available and respond quickly and clearly.
- Punctuality: arriving at the agreed time is non-negotiable.
- Good practices: respect HACCP, hygiene, and safety at all times.
- Responsible sourcing: use quality products and reliable suppliers when applicable.
- Clean and neat work: leave the kitchen the same as or better than it was found.
- On-site preparation: cook everything at the client's home, unless expressly authorized.
- Replicate official menus: respect SoCool Chef's website recipes and standards when required.
- Cordial distance: maintain a professional, friendly, but not invasive relationship.
- Discreet departure: finish the service elegantly, without causing inconvenience.
- Confidentiality: maintain absolute silence about what was seen, heard, or known during each service.
- Brand loyalty: always act for the benefit of SoCool Chef, defending its reputation, and promoting the community.
4. Payments and commissions
- The client pays SoCool Chef 100% of the service fee.
- The Company retains a management commission (between 18% and 30%, depending on the agreement).
- The remaining amount is transferred to the Chef after the service is rendered and the file is closed.
- Payment is made within a maximum of 7 business days after the event, barring incidents.
- The Chef is responsible for their tax and social security obligations.
5. Service duration and overtime
- For one-off events, 6 standard working hours are considered:
- 1 h for shopping and initial preparation.
- 5 h on-site (cooking, plating, service, cleaning).
- The 5 h on-site start counting 2 h after the start time agreed with the client, even if the service has not begun.
- Overtime is charged at 65 €/extra hour per chef (and per additional team member if applicable).
- The Chef must notify the Maître d' of any overtime for registration and approval.
6. Cancellations
- If the client cancels, the Chef will receive their proportional share based on the proximity of the date, according to the current cancellation policy.
- If the Chef cancels:
- The incident will be recorded in their file.
- They may lose priority in future assignments.
- Repeated cancellations may result in permanent removal.
- The Chef must immediately inform of any impossibility to cover a service.
7. Chef's responsibility
The Chef will be responsible for:
- The preparation of the dishes as agreed.
- Making all purchases for their menu, selecting quality ingredients and ensuring their correct handling and transport.
- Guaranteeing hygiene, safety, and respect for the client's facilities.
- Assuming responsibility for damages caused by personal negligence.
- Maintaining absolute confidentiality about the client and their guests.
8. Professional conduct
- The Chef must refrain from directly soliciting clients for private services outside of SoCool Chef.
- Any attempt to circumvent the platform may lead to immediate expulsion and potential claims.
- The Chef is an ambassador for the brand: every service affects the reputation of all.
9. Dispute resolution
If problems arise during or after a service:
- During the event: the Chef must try to resolve minor complaints directly (adjustments to dishes, service pace).
- Client complaints: if the client submits a formal complaint, SoCool Chef will open a mediation process.
- Withheld payments: amounts may be withheld until the situation is clarified.
- Evidence: the Chef must provide their version, messages, photos, or purchase documentation.
- Final decision:
- Full payment to the Chef if they complied with the agreement.
- Partial payment if there were partial deficiencies.
- Total retention if there was a serious breach.
- SoCool Chef's decision will be binding regarding the funds managed.
10. Reviews and reputation
- The client can leave a public rating after the service.
- The Chef's reputation will be affected by these reviews, which will influence the assignment of future jobs.
11. Intellectual property and image use
- Recipes and menus created under SoCool Chef may be reused by the Company in catalogs or marketing.
- The Chef retains authorship over their creations but grants SoCool Chef a right of use for operational and promotional purposes.
- The Chef expressly authorizes SoCool Chef to use their images, personal photographs, photos of dishes, menus, and reviews for the purpose of promoting the brand and the community, both in digital media (website, social networks, newsletters) and in printed materials (catalogs, brochures, presentations).
- This authorization is free, non-exclusive, and revocable in writing at any time, without affecting prior uses.
12. Data protection
- The Chef must protect clients' personal information and may not use it for purposes unrelated to the service.
- Failure to comply with this clause will constitute a serious sanction.
13. Limitation of liability
- SoCool Chef assumes no responsibility for the Chef's tax, labor, or health breaches.
- The Chef acts as an independent professional and must have necessary insurance or coverage.
- SoCool Chef will only be responsible for incidents arising from its direct management.
14. Modifications
- SoCool Chef may update these Terms.
- They will be deemed accepted upon participation in new bookings.
